ASSOCIATION OF COMMUNITIES IN THE CONTEXT OF DECENTALIZATION REFORM: MAIN RESULTS AND NEXT STEPS

Abstract

The article reveals the main consequences of the unification of territorial communities as the main goal of decentralization reform. It is shown that the functioning of local governments in most territorial communities does not ensure the creation and maintenance of a favorable living environment necessary for the comprehensive development of man, his self-realization, protection of his rights, providing the population with local governments.

It focuses on the analysis of the results of the implemented reforms and activities, which show that the authorities have initiated a number of fundamental processes at various territorial levels. In particular - fiscal decentralization, which consists in the transfer to the communities of state taxes and the introduction of local taxes; unification / consolidation of communities and redistribution of powers to provide a number of public services in favor of territorial communities.

The experience of the Netherlands in the voluntary association of communities, which had positive consequences for budget issues at the municipal level, is analyzed. At the same time, emphasis is placed on the experience of European countries, where the transfer of authority and resources from higher to lower levels of government did not guarantee the automatic provision of efficient public services, especially in the context of slowing economic dynamics.

It is stated that the period of voluntary association / accession of territorial communities in Ukraine was based on the creation of capable territorial communities - such communities of villages, towns, cities, as a result of voluntary association are able to independently or through local governments to ensure adequate public services, in particular in education. culture, health, social protection.

The implemented unification / consolidation of communities requires rapid changes in a number of legislative acts defining key areas of state regional policy. In particular, it is a question of making changes in the Law of Ukraine "About bases of the state regional policy", the State strategy of regional development, and also others connected with development and implementation of strategies of local and regional development taking into account consolidation of communities and administrative areas.
