Regulatory and legal mechanism of quality control of housing and communal services by bodies of self-organization of the population in modern Ukraine

Abstract

The article describes the normative-legal mechanism of control over the quality of housing and communal services by the bodies of self-organization of the population in modern Ukraine and proposes its theoretical and practical improvement. In the context of the subject of research the substantial essence of bodies of self-organization of the population is revealed; their main tasks and powers are indicated; their functions are classified according to the subject; the control function of the bodies of self-organization of the population is separately characterized. The understanding of the terms “control”, “housing and communal services”, “quality of housing and communal services” is indicated. Identified: types of housing and communal services; regulations governing the requirements for the provision of existing types of housing and communal services; entities that the legislator has the authority to control the quality of housing and communal services. Certain provisions of the Law of Ukraine “On Housing and Communal Services” of November 9, 2017 № 2189-VIII in the context of the study of the regulatory mechanism for quality control of housing and communal services by the self-organization of the population in modern Ukraine are described. As elements of a complex normative-legal mechanism of control over the quality of housing and communal services by the bodies of self-organization of the population in modern Ukraine the mechanism of public control and the mechanism of protection of the rights of consumers of housing and communal services - act-claim are characterized. The current normative-legal acts as normative-legal provision as an element of the complex normative-legal mechanism of control over the quality of housing and communal services by the bodies of self-organization of the population in modern Ukraine are characterized. It is offered: to the modern legislator to develop the effective and vital-practical mechanism of control over quality of housing and communal services by bodies of self-organization of the population taking into account existing realities of modern Ukraine (activation of civil society and aggravation of a social and economic situation); newly united territorial communities in 2020 to develop and approve effective local programs of reform and development of housing and communal services, taking into account the need to involve the public in the process of quality control of housing and communal services; local public authorities to develop a single algorithm for consumers of housing and communal services to ensure the participation of members of territorial communities in the implementation of public control over the provision of services for the maintenance of buildings and structures and adjacent territories; public authorities of the newly created territorial communities in 2020 to intensify the process of development and approval of local Regulations “On public inspectors in the field of housing and communal services”. Perspective directions of further theoretical and practical researches concerning improvement of the normative-legal mechanism of control over quality of housing and communal services by bodies of self-organization of the population in modern Ukraine are defined.
