Genesis of legal regulation of pension security in Ukraine

Abstract

The relevance of the study is determined by the fact that the basis of the pension system of Ukraine was laid back in the Soviet period and, starting from 1991, has been repeatedly reformed. The article presents the results of research into the genesis of legal regulation in the field of pension provision and the relevant legislation of Ukraine. It was revealed that legal regulation in the field of pension provision in Ukraine is constantly in a state of reform. It was found that the legislator was not able to carry out a complete, comprehensive pension reform, but stretched it over time (for more than 30 years). It was emphasized that the reform of legal regulation in the field of pension provision has not yet been completed. The previous changes to the pension legislation in 1991, 2003 and 2011 should be considered not as a complete pension reform, but as three stages of a single legal reform of the pension legislation. It was established that the key legal act regulating pension relations is the Law of Ukraine "On Mandatory State Pension Insurance" (2003). This legal document determined the levels of pension provision in Ukraine, the functioning of which cannot be considered perfect. The legislative changes of 2011 did not help to solve this issue. On this basis, it is justified that the implementation of the next stage of pension reform should be final and solve the following problems: 1. Pension legislation should be systematized, unified and codified in one document - the Pension Code of Ukraine. 2. It is necessary to resolve the question of the feasibility of implementing the second level of the pension system (cumulative mandatory pension insurance), as well as to decide on the forms (methods) of implementing these innovations. 3. To improve the domestic pension legislation in order to increase the motivation of citizens to participate in the third level of the pension system (non-state pension provision). 4. Harmonize (ensure convergence) general and special pension provision, which is a condition for social stability and social justice as a feature of a democratic, legal and social state.
