LEGAL PRINCIPLES OF PERSONNEL MANAGEMENT IN THE CIVIL SERVICE IN THE CONTEXT OF THE DEVELOPMENT OF THE INFORMATION SOCIETY

The article analyzes the regulatory and legal regulation of personnel management in the civil service in the context of the development of the information society. Ways to improve the legal framework of personnel management in the civil service are formulated. These ways are aimed at enhancing the professionalization of civil servants and developing their ability to work in a digital environment, as well as increasing the efficiency of government agencies. At the beginning of the study, it is stated that the legal principles of personnel management in the civil service constitute a set of regulatory legal acts that regulate labor relations, determine the procedure for personnel selection, promotion, implementation of the conditions for civil service and its termination, compliance with ethical standards and prevention of corruption, evaluation of the results of professional activities of civil servants and holding them accountable. The constitutional principles of the functioning of the civil service and the management of the civil service personnel are disclosed. A comparative analysis of the Labor Code of Ukraine and the Law of Ukraine «On Civil Service» regarding the regulation of personnel management issues is conducted. Particular attention is paid to the role of regulatory acts regulating the optimization of the work of civil servants, including under martial law, the professionalization of civil servants, increasing the transparency and efficiency of personnel procedures, the formation of a competency-based approach, and the development of digital competencies of personnel. It is shown that current legal acts provide opportunities for the implementation of electronic document management, remote work, and flexible personnel management mechanisms in the civil service in crisis conditions. At the same time, the importance of the Cybersecurity Strategy of Ukraine, which orients the civil service towards the formation of new digital skills and security standards, is emphasized. At the end of the article, it is concluded that the modern system of legal regulation of personnel management in the civil service creates the basis for the development of a professional and digitally oriented civil service capable of functioning effectively in the face of military challenges and digital transformation. At the same time, attention is focused on the fact that the current legislation does not fully meet the modern challenges of the information society and digitalization processes. Accordingly, ways of improving the legal framework of personnel management in the civil service are proposed.
