INTERNATIONAL STANDARDS AND LEGAL SUPPORT OF NATIONAL STATE POLICY IN THE FIELD OF CORRUPTION PREVENTION

The article analyzes international standards and legal support of national state policy in the field of corruption prevention. At the beginning of the study, it is noted that today there are a number of international standards which regulate the prevention of corruption. These standards have been developed over many years by international organizations in collaboration with dozens of countries to establish common norms, principles, and practices to address a societal problem – overcoming corruption and its consequences, which has been recognized as a global threat. The main part of the article is devoted to the analysis of the provisions of individual international documents, which have become a guide for the development and implementation of the national state policy in the field of corruption prevention and directly anti-corruption regulatory acts. Accordingly, the main aspects of legislative acts as determining factors in the fight against corruption are considered, and the provisions of some of them are compared. The advantages and disadvantages of legal documents regulating the prevention of corruption are highlighted, and their anti-corruption impact is described. It is summarized, which regulatory acts are adopted as an important step in reforming the public administration system and implementing European standards of integrity and good conduct. It is emphasized that despite numerous anti-corruption laws, there is no single codified legal act in Ukraine that would provide for a procedure for bringing a person who has committed corrupt acts or other misconduct to disciplinary responsibility. In addition, in the article notes, that an important strategic role in the formation of the legal framework in the field of corruption prevention is played by Decrees of the President of Ukraine, Government Resolutions and Orders and regulatory acts of the NAPC. At the end of the article, the conclusion is made, that international anti-corruption standards are aimed at: preventing corruption; ensuring transparency and accountability in the public and private sectors; punishing corruption crimes; establishing and strengthening international cooperation to overcome cross-border corruption. Together with international standards, the national legal framework ensures proper legal regulation of state policy in the field of corruption prevention and reflects the state’s position on the inadmissibility of tolerance for any manifestations of corruption in the field of public administration and in other public spheres.
