FEATURES OF THE LEGISLATIVE PROVISION OF THE HEALTH CARE SYSTEM IN UKRAINE IN THE CONDITIONS OF SYSTEMIC TRANSFORMATIONS

This article examines the features of the legal framework that supports the implementation of public policy in the healthcare sphere during systemic transformations. Emphasis is placed on the relevance of the issue within the context of socio-economic instability, the full-scale armed aggression against Ukraine, and the necessity to develop a new model of public administration in this sector. The primary challenges facing the domestic healthcare system include legislative fragmentation, a lack of intersectoral coordination, and inadequate mechanisms for implementing strategic documents. Attention is focused on analyzing the stages of healthcare reform and the relevant legal acts since 2017. The sequence of regulatory and legal support at each stage of reform is identified as a key factor in effective public policy within the medical sphere. The article outlines the key aspects of implementing the Medical Guarantees Programme, the autonomy of healthcare institutions, the creation of hospital districts, the digital transformation of healthcare, and the adoption of the “money follows the patient” principle. The interconnections among documents of various levels: the Constitution of Ukraine, Ukrainian laws, sectoral strategies, and concepts are explored. Legal acts should create a coherent framework that facilitates logical reform, prevents legal conflicts, and ensures consistency in regulatory measures over the medium to long term. The quality of medical services is emphasized as a strategic goal of the reform, necessitating modern legal regulation tools, analytical support, and cross-sector cooperation. Conclusions highlight the necessity of enhancing the normative framework to address current challenges, especially in post-war recovery, demographic shifts, and the digitalization of governance. The article substantiates future research directions that focus on developing integrated, flexible, and effective legal support for public policy in the examined sphere.
