Abstract

In this article the author analyzes the current state of public procurement in Ukraine, pointing out that recently scientists are paying more attention to this field, examines the experience of public procurement in leading foreign countries, which can be implemented in Ukraine. Indicates that the basic concepts of the current model of the contract system remain outside the mandatory and formally defined categories in the conditions of legislative instability. Formulates the task of systematizing the conceptual and terminological apparatus to distinguish and differentiate individual segments of the procurement market. The completed review of international and national documents makes it possible, to some extent, to condition the systematization of the scope of procurement regulation in the countries concerned. The maximum scale of procurement regulation is observed in the EU directives and legal acts of the European countries under consideration, including the procurement of structures governed by public law.

Thus, the creation of an effective contract procurement system should be one of the key priorities of the Ukrainian economy's development strategy. Due to the variability in the use of different contractual agreements, the state can generate effective demand and, on a mutually beneficial basis, involve private business in solving socially significant tasks in the face of budget constraints and economic difficulties. It is proposed to divide the procurement regulation system into three separate segments: government procurement; procurement of state-owned enterprises; procurement of utility and / or infrastructure enterprises. This will allow, on the one hand, to expand the boundaries of the contract system and, on the other, to develop more segmented and 'targeted' procurement regulation mechanisms. It is concluded that the considered strategic approach to the formation of the contract model involves the development and implementation of a new procurement policy and regulatory system in the field of public procurement.
